1. Acceptance
Use of simulix.com, api.simulix.com, the dashboard, the hosted documentation, and any associated SDK constitutes acceptance of these terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these terms, do not use the service.
2. Account and credentials
You are responsible for the custody of any API keys (sk_live_* or sk_test_*) issued through the dashboard. Treat live API keys as you would a password. Sharing credentials with third parties, embedding live API keys in client-side code, or transmitting them over insecure channels is prohibited. We will revoke any key on request or where we have reasonable grounds to suspect compromise.
Each organization is responsible for its own users and key administration. Suspending a user does not by itself revoke their issued keys; both actions must be taken from the dashboard.
3. Fees and billing
Subscription fees, plan tiers, included rate limits, and agent caps are described on the pricing page. Billing is processed monthly through Stripe. Plan changes and cancellations take effect at the end of the then-current billing period unless otherwise noted.
Sandbox accounts (test-mode keys only) are free of charge for evaluation and integration testing, subject to the sandbox tier's rate limits and agent caps.
4. Acceptable use
You agree not to: (a) reverse engineer, decompile, or attempt to extract source code from the service except where permitted by applicable law; (b) probe, scan, or test the vulnerability of the service except through our published responsible disclosure channel; (c) use the service to generate or propagate content that violates the Cloudflare Workers AI acceptable use policy (the service's sole upstream LLM provider); (d) submit simulation requests designed to exfiltrate data, circumvent rate limits, or otherwise abuse the platform; or (e) use the service in violation of applicable law.
Where Cloudflare Workers AI rejects a request as policy-violating, the rejection propagates back to the calling API key without modification.
5. Intellectual property
You retain ownership of the simulation inputs you submit and of the structured outputs returned by the API. Simulix retains ownership of the platform, the workflow catalog, the aggregator definitions, and any case-study content auto-generated from anonymized benchmark runs. Where a case study would expose customer-identifying information, that case study is not generated.
You grant Simulix a limited license to process your submitted inputs solely to deliver the service and, where you have explicitly opted in, to use anonymized aggregates for service improvement.
6. Warranty disclaimer
The service is provided AS IS and AS AVAILABLE. Simulix disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
The internal K-sample confirmation gate used by the calibration pipeline is a quality control mechanism for workflow promotion and is not a customer-facing service level commitment. Accuracy claims associated with specific workflows reflect benchmark conditions and may not generalize to your particular use case.
7. Limitation of liability
To the maximum extent permitted by law, Simulix's aggregate liability arising out of or related to the service shall not exceed the fees paid by you to Simulix in the twelve (12) months preceding the event giving rise to the claim. In no event shall Simulix be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.
8. Termination
You may cancel your subscription at any time through the Stripe Customer Portal accessible from the dashboard billing page. On cancellation, paid features remain available through the end of the then-current billing period; the account then reverts to the sandbox tier.
Simulix may suspend or terminate accounts for material breach of these terms, including violations of the acceptable use policy. We retain account data for thirty (30) days after termination to enable reactivation, then purge it. Customer-supplied simulation inputs and generated outputs are purged on the same schedule.
9. Governing law and venue
These terms are governed by the laws of the State of [Delaware, USA], without regard to its conflict-of-laws principles. Disputes arising out of or relating to these terms or the service shall be brought exclusively in the state or federal courts located in [Delaware, USA].
